Terms of Sale

MCH Analytics is sold by MCH GROUP. Contact: contact@mchgroup.fr. The seller's legal details (company name, legal form, registration number, VAT number, registered address) are listed in the Legal Notice.

These terms of sale (the “Terms of Sale”) govern the subscription to MCH Analytics, a cookieless website analytics service accessible from the hub at intern.mchgroup.fr (the “Service”), between MCH GROUP and any person who subscribes to it (the “Customer”), whether a consumer or a professional. They apply together with the Terms of Use and the Privacy Policy. The Customer accepts them by ticking the box provided before paying.

The Service is offered in the following plans. Prices are per month, in euros.

• Starter — 3 € / month: 1 website, 50,000 pageviews / month, 12 months of history, 5 goals, MCP, read access, Cookieless visits, AI assistants and crawlers, Customers and revenue for each X post, 20 tracked links for posts, 7-day forecast and auto segments.
• Pro — 12 € / month: 5 websites, 300,000 pageviews / month, 24 months of history, Unlimited goals, MCP, read access, Cookieless visits, AI assistants and crawlers, Customers and revenue for each X post, Unlimited tracked links for posts, 7-day forecast and auto segments, Segment export (CSV), 2,000 replay sessions / month, kept 30 days.

The price applicable is the one displayed at the time of subscription. Any change of price applies only from the next billing period after the Customer has been informed at least 30 days in advance; the Customer may cancel before it applies.

Each new account can use the Starter features free of charge for 3 days, once, without entering any payment details. Nothing is charged at the end of this period: access to the Service stops until the Customer chooses a paid plan. Sites and data are kept, within the retention limits of the Privacy Policy.

The Customer subscribes from the Billing page of the hub. Payment is processed by Stripe Payments Europe, Ltd.; MCH GROUP never sees or stores card details. The first payment is taken when the subscription starts, then every month on the same date. An invoice is issued for each payment and remains available from the Billing page (“Invoices and payment method”).

If a payment fails, Stripe retries it for a few days and the Customer is informed in the hub. If it still fails, the subscription ends and access to the Service stops.

The subscription is concluded for one month and renews automatically every month for one more month, at the price of the current plan, until the Customer cancels it. The renewal date is always shown on the Billing page.

Moving to a higher plan takes effect immediately. Moving to a lower plan takes effect at the end of the current billing period; the period already paid is not refunded.

The Customer can cancel at any time, without giving a reason and without fees, directly from the Billing page of the hub (“Cancel subscription”), or by writing to contact@mchgroup.fr. Cancellation is confirmed on screen with the date access ends.

Cancellation takes effect at the end of the billing period already paid: the Service remains accessible until that date, then access stops and no further payment is taken. The period in progress is not refunded, except where the law provides otherwise. Until that date, the Customer can resume the subscription from the same page.

A Customer acting as a consumer has a right of withdrawal of 14 days from the subscription, under Articles L221-18 and following of the French Consumer Code. Because the Service starts immediately, the Customer is asked, before paying, to expressly request immediate access. If the Customer withdraws within 14 days, MCH GROUP refunds the amount paid, minus the share corresponding to the days of Service already provided (Article L221-25). To withdraw, the Customer writes to contact@mchgroup.fr, for example: “I hereby withdraw from my MCH Analytics subscription ordered on [date], account [email].” The refund is made within 14 days, by the payment method used.

The free 3-day offer lets the Customer try the Service before paying.

MCH GROUP provides the Service with reasonable care and endeavours to keep it available at all times, except during maintenance or events beyond its control. The Customer remains responsible for installing the tracking script on its own sites and for informing its own visitors as required by law.

The figures shown by the Service, including the attribution of visitors, signups and customers to a source or to a post, are estimates based on the data available; they are provided for information. Except for gross negligence, the liability of MCH GROUP towards a professional Customer is limited to the amounts paid over the last 12 months. Nothing in these Terms of Sale limits the rights a consumer holds under the law, in particular the legal guarantee of conformity for digital services (Articles L224-25-12 and following of the French Consumer Code).

The personal data of the Customer (account, billing) is processed as described in the Privacy Policy. For the data of the visitors of its own sites, the Customer acts as controller and MCH GROUP as processor.

In case of a problem, the Customer first writes to contact@mchgroup.fr. A consumer Customer may then refer the matter, free of charge, to the consumer mediator named below.

These Terms of Sale are governed by French law. Failing an amicable solution, disputes are brought before the competent French courts; a consumer may also bring the matter before the court of their place of residence.
